Terms of Service
Last updated: September 22, 2026
1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of the Evolv Tax website, client portal, and tax-preparation services (collectively, the "Services"). By using the Services or engaging us to prepare a return, you agree to these Terms. If you do not agree, do not use the Services.
2. The services we provide
Evolv Tax prepares and e-files US federal and state tax returns and related filings (including ITIN applications, FBAR/FATCA reporting, and US–India treaty returns) based on the information and documents you provide. We are an IRS-authorized e-file provider. The scope of any engagement is limited to the specific returns and services you request.
3. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Your responsibilities
You agree to provide accurate, complete, and timely information and documents. You are responsible for reviewing your return before it is filed and for the accuracy of the information you supply. We rely on your information and are not responsible for errors resulting from incomplete or inaccurate details you provide.
5. Fees and payment
Fees for our services are as described on our pricing page or in your engagement, and are due as agreed. Government filing costs and any third-party charges are separate. Fees are for preparation and filing services and are not contingent on any particular refund or tax outcome.
6. No guarantee of outcome; not legal or investment advice
We use professional care to prepare accurate returns, but we do not guarantee any specific refund, tax liability, or that a return will not be examined by a tax authority. The Services are tax-preparation services and do not constitute legal, investment, or personalized financial advice.
7. Third-party services and links
The Services may link to third-party sites (such as IRS and state refund or payment tools). We are not responsible for the content, accuracy, or practices of those sites, which are governed by their own terms.
8. Confidentiality and privacy
We handle your information in accordance with our Privacy Policy. You agree that we may use and disclose your information as needed to provide the Services and as required by law.
9. Intellectual property
The Evolv Tax name, logo, site, and content are owned by Evolv Tax and protected by applicable law. You may not copy, modify, or redistribute them without permission.
10. Limitation of liability
To the fullest extent permitted by law, Evolv Tax will not be liable for indirect, incidental, or consequential damages, and our total liability arising out of the Services will not exceed the fees you paid for the specific engagement giving rise to the claim. Some jurisdictions do not allow certain limitations, so some may not apply to you.
11. Indemnification
You agree to indemnify and hold Evolv Tax harmless from claims arising out of information you provide that is inaccurate or incomplete, or from your misuse of the Services.
12. Termination
You may stop using the Services at any time. We may suspend or end access if you breach these Terms or misuse the Services. Provisions that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws of the applicable jurisdiction in which Evolv Tax operates, without regard to conflict-of-law rules.
14. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the date above, and continued use of the Services means you accept the updated Terms.
